The cross of medicine and spas certainly bring new opportunities and benefits, yet with the relatively fresh trend comes downfalls and tricky questions that must be addressed in order to stay on top:

  • Did you know that receiving a commission for performing Botox or laser treatment is illegal in almost every state?
  • Or that opening a medical spa and contracting with a medical director often violates state law?
  • And what about Groupon and patient referral programs— did you know they are often considered illegal fee splitting?
Aesthetic and laser practitioners nationwide receive fines and suspensions everyday for violating state laws and regulations. Often these punishments are easily avoidable.  In this session, Thiersch discusses the three most common legal pitfalls in the industry and how to avoid them.

Alex R. Thiersch, founder and legal counsel for the American Med Spa Association, is an attorney at law—a member of the American Bar Association, the Illinois State Bar and the Chicago Bar Association—who specializes in representing med spas and advising clients on the relevant laws and regulations affecting the med spa industry. With his extensive experience, Thiersch regularly lectures nurses, estheticians, physician assistants and physicians throughout the country on med spa regulations.
